Regeringen har for nylig sl\u00e5et h\u00e5rdt ned p\u00e5 korttidsudlejning og indf\u00f8rt nye regler. For vejledning i konkrete sager bedes De kontakte en ejendomsadvokat. <\/em><\/p>\n<h2>Regler for korttidsudlejning i Quebec<\/h2>\n<p>I Quebec skal De registrere enhver form for turistindkvarteringsvirksomhed. Det vil sige enhver boligenhed, De udlejer i perioder p\u00e5 31 sammenh\u00e6ngende dage eller derunder. <\/p>\n<p>Dette omfatter:<\/p>\n<ul>\n<li aria-level=\"1\">V\u00e6relser<\/li>\n<li aria-level=\"1\">Suiter<\/li>\n<li aria-level=\"1\">Lejligheder<\/li>\n<li aria-level=\"1\">Huse<\/li>\n<li aria-level=\"1\">Telte og campingvogne<\/li>\n<\/ul>\n<p>F\u00f8r De kan registrere Dem, skal De indhente en overensstemmelseserkl\u00e6ring (Notice of Compliance) for Deres ejendom. Den dokumenterer, at De kan drive Deres korttidsudlejningsvirksomhed i henhold til de lokale vedt\u00e6gter. De kan finde og downloade formularen <a href=\"https:\/\/citq.qc.ca\/documents\/Avis-de-conformite.pdf\">her<\/a>.  <\/p>\n<p>Quebec g\u00f8r en undtagelse, hvis De bruger Deres prim\u00e6re bop\u00e6l. De pr\u00e6ciserer, at det betyder det sted, hvor De bor, tilbringer det meste af Deres tid og bruger som Deres hovedadresse. De skal stadig registrere Dem, men De beh\u00f8ver ikke godkendelse fra den lokale myndighed.  <\/p>\n<p>Derefter kan De registrere Dem hos Corporation de l&#8217;industrie touristique du Qu\u00e9bec (CITQ). Hvis det er Deres prim\u00e6re bop\u00e6l, skal De bruge denne <a href=\"https:\/\/citq.qc.ca\/en\/Page_debut1.php\">formular<\/a>. Ellers skal De udfylde denne <a href=\"https:\/\/citq.qc.ca\/en\/Page_1ouverture.php\">formular<\/a> og vedl\u00e6gge f\u00f8lgende:  <\/p>\n<ul>\n<li aria-level=\"1\">En kopi af overensstemmelseserkl\u00e6ringen (Notice of Compliance)<\/li>\n<li aria-level=\"1\">Sk\u00f8de, skatteopg\u00f8relse eller lejekontrakt<\/li>\n<li aria-level=\"1\">Dokumentation for mere end 2 mio. CAD i ansvarsforsikring<\/li>\n<li aria-level=\"1\">En erkl\u00e6ring fra medejere eller lejer (hvis relevant)<\/li>\n<\/ul>\n<p>N\u00e5r De har indsendt ans\u00f8gningen, kontakter CITQ Dem vedr\u00f8rende betaling af registreringsgebyret. Bel\u00f8bet \u00e6ndrer sig \u00e5rligt og afh\u00e6nger af Deres virksomhedstype. N\u00e5r De har betalt, modtager De Deres registreringsbevis (ogs\u00e5 kaldet et klassifikationsbevis).  <\/p>\n<p>De skal derefter forny Deres registrering \u00e5rligt og fortsat betale gebyrerne. Hvis De ikke opfylder nogen af disse krav, kan De f\u00e5 en b\u00f8de p\u00e5 op til $100.000. <\/p>\n<p>Korttidsudlejningsplatforme som Airbnb og Vrbo har ogs\u00e5 ansvar for at sikre, at hver ejendom har et registreringsnummer. Hvis de findes at have ulovlige opslag, bliver de ramt af tilsvarende sanktioner. <\/p>\n<p>Quebec har indf\u00f8rt disse h\u00e5rde straffe for at afskr\u00e6kke folk fra at drive ulovlige Airbnbs. De \u00f8nsker at regulere STR\u2019er og sikre, at de er trygge for g\u00e6ster. <\/p>\n<h2>Skattekrav for quebeciske korttidsudlejninger<\/h2>\n<p>Alle virksomheder i Canada er underlagt national indkomstskat. Startskattesatsen er 38 %, som typisk s\u00e6nkes til 15 %. <\/p>\n<p>I mods\u00e6tning til de fleste andre provinser h\u00e5ndterer Quebec sine indkomstskatter separat. Det betyder, at De skal betale disse skatter direkte til Revenu Qu\u00e9bec og ikke til Canada Revenue Agency (CRA). Quebec har et trinvist skattesystem, som ligger mellem 14 % og 25,75 %.  <\/p>\n<p>Ud over indkomstskat skal De typisk opkr\u00e6ve og afregne f\u00f8lgende bel\u00f8b fra g\u00e6ster:<\/p>\n<ul>\n<li aria-level=\"1\">Goods and Sales Tax (GST) p\u00e5 5 %<\/li>\n<li aria-level=\"1\">Quebec Sales Tax (QST) p\u00e5 9,975 %<\/li>\n<li aria-level=\"1\">Overnatningsskat p\u00e5 3,5 %<\/li>\n<li aria-level=\"1\">Kommunal indkvarteringsskat<\/li>\n<\/ul>\n<p>Hvis g\u00e6ster betaler via en bookingplatform, er operat\u00f8rerne i stedet ansvarlige for at afregne alle disse skatter.<\/p>\n<h2>Regler for korttidsudlejning i popul\u00e6re quebeciske destinationer<\/h2>\n<p>Lokale myndigheder fasts\u00e6tter ofte deres egne regler for turistindkvartering. Derfor er det vigtigt at s\u00e6tte sig ind i alle regler b\u00e5de p\u00e5 provins- og kommuneniveau. <\/p>\n<p>Her er lovgivning og retningslinjer for korttidsudlejning i popul\u00e6re omr\u00e5der i Quebec:<\/p>\n<h3>Montreal<\/h3>\n<p>Montreal har et blomstrende marked for ferieudlejning, hvor de fleste ankommer om for\u00e5ret eller efter\u00e5ret. Mange bes\u00f8gende s\u00f8ger indkvartering i de historiske gader i Old Montreal eller i n\u00e6romr\u00e5det. <\/p>\n<p>Den st\u00f8rste begr\u00e6nsning er Montreals strenge zonelovgivning. Mange af byens bydele forbyder korttidsudlejning i boligomr\u00e5der. De kan tjekke reglerne for det omr\u00e5de, De overvejer, <a href=\"https:\/\/montreal.ca\/demarches\/secteurs-autorises-pour-exploiter-une-residence-de-tourisme\">her<\/a>.  <\/p>\n<p>Virksomheder skal ogs\u00e5 overholde Montreals krav til sundhed og hygiejne for beboede boliger. Disse sikrer, at ejendomme er rene, sikre og velholdte. Et af de st\u00f8rste krav er, at De har tilstr\u00e6kkelig plads til alle Deres lejere og g\u00e6ster.  <\/p>\n<h3>Quebec City<\/h3>\n<p>Som UNESCO-verdensarv har Qu\u00e9bec City meget at byde p\u00e5 for turister. Dens historiske gader og betagende udsigter tiltr\u00e6kker typisk millioner af bes\u00f8gende hvert \u00e5r. <\/p>\n<p>P\u00e5 grund af den h\u00f8je eftersp\u00f8rgsel planl\u00e6gger Qu\u00e9bec City at stramme reglerne for korttidsudlejning. Regeringen gennemg\u00e5r i \u00f8jeblikket lovgivningen og r\u00e5df\u00f8rer sig med beboerne. De har arrangeret borgerm\u00f8der i alle de st\u00f8rre bydele i slutningen af 2024 og begyndelsen af 2025.  <\/p>\n<p>Reglerne er allerede strengere for prim\u00e6re beboere. De skal indhente en tilladelse, f\u00f8r De tager imod g\u00e6ster, og De er begr\u00e6nset til 90 dage pr. kalender\u00e5r. <\/p>\n<h3>Sherbrooke<\/h3>\n<p>Sherbrooke, der er kendt som hjertet af Eastern Townships, byder p\u00e5 en blanding af kultur, sport og fritidsaktiviteter. Det er ogs\u00e5 et mere prisvenligt alternativ til Montreal og Qu\u00e9bec City. <\/p>\n<p>Sherbrooke tillader heller ikke ferieudlejning i visse omr\u00e5der af byen. De kan tjekke Deres ejendom ved at se p\u00e5 deres <a href=\"https:\/\/cartes.ville.sherbrooke.qc.ca\/refonte\/\">interaktive kort<\/a> eller kontakte de lokale myndigheder. <\/p>\n<h3>Magog<\/h3>\n<p>Selvom Magog kun er et lille sted, f\u00e5r det stadig sin del af bes\u00f8gende. Der er mange udend\u00f8rsaktiviteter p\u00e5 grund af den n\u00e6rliggende s\u00f8 og bjergene. <\/p>\n<p>Magog har strenge zonevedt\u00e6gter ligesom nabobyerne. De skal tjekke, om korttidsudlejning er tilladt i Deres omr\u00e5de, og eventuelt arrangere en inspektion. Bes\u00f8g <a href=\"https:\/\/www.ville.magog.qc.ca\/informations-services\/permis\/?hilite=airbnb#hebergement-touristique\">denne webside<\/a> for at arrangere dette.  <\/p>\n<p>Byen har ogs\u00e5 flere begr\u00e6nsninger for g\u00e6ster. Reglerne siger, at De kun m\u00e5 huse \u00e9n person eller \u00e9n gruppe af besl\u00e6gtede personer ad gangen. Med andre ord kan De ikke acceptere flere bookinger for de samme datoer.  <\/p>\n<p>Hvis De kommer uden for Quebec og ikke taler fransk, skal De v\u00e6re opm\u00e6rksom p\u00e5, at Magogs kommunale hjemmeside ikke har en engelsk mulighed.<\/p>\n<h3>Mont-Tremblant<\/h3>\n<p>Kun to timers k\u00f8rsel fra Magog finder De den smukke ferieby Mont-Tremblant. Den er mest travl om vinteren p\u00e5 grund af skil\u00f8jperne. De kan dog forvente eftersp\u00f8rgsel p\u00e5 indkvartering \u00e5ret rundt, da Mont-Tremblant har et udvalg af butikker og gode restauranter.  <\/p>\n<p>Mont-Tremblant har for nylig indf\u00f8rt en h\u00f8jere skattesats for turistindkvartering. Form\u00e5let er at skabe flere indt\u00e6gter, der kan hj\u00e6lpe med at l\u00f8se boligkrisen. <\/p>\n<p>Som tidligere skal De tjekke, om De har ret til at drive en STR-virksomhed i Deres omr\u00e5de. Mont-Tremblant har et <a href=\"https:\/\/www.villedemont-tremblant.qc.ca\/fr\/citoyens\/urbanisme\/residence-de-tourisme\">interaktivt kort<\/a>, De kan bruge. De skal unders\u00f8ge, om De skal ans\u00f8ge om et certifikat for \u00e6ndret anvendelse. Hvis ja, skal De indhente det hos kommunen.   <\/p>\n<h3>Gatineau<\/h3>\n<p>If\u00f8lge en nyere rapport har Gatineau et af de mest prisvenlige ejendomsmarkeder i Canada. Og som om det ikke var nok, tiltr\u00e6kker byen et h\u00f8jt antal turister \u00e5ret rundt. <\/p>\n<p>Byen kr\u00e6ver generelt blot, at udlejere af ferieboliger f\u00f8lger quebecisk lovgivning. Den har dog detaljerede retningslinjer for ejendomsstandarder. Som ejer skal De:  <\/p>\n<ul>\n<li aria-level=\"1\">Holde ejendommen i god stand<\/li>\n<li aria-level=\"1\">Fjerne blade og andet planteaffald<\/li>\n<li aria-level=\"1\">Sikre, at skraldespande er lukket med et t\u00e6tsluttende l\u00e5g<\/li>\n<li aria-level=\"1\">Vedligeholde gr\u00f8fter p\u00e5 Deres grund<\/li>\n<\/ul>\n<p>Bem\u00e6rk, at byen Gatineau forbeholder sig retten til at inspicere Deres ejendom n\u00e5r som helst og give Dem en b\u00f8de, hvis de afd\u00e6kker problemer.<\/p>\n<h2>Kommende \u00e6ndringer i Quebecs lovgivning om korttidsudlejning<\/h2>\n<p>Den canadiske presse afsl\u00f8rede for nylig, at <a href=\"https:\/\/montreal.ctvnews.ca\/123456-are-quebec-airbnb-hosts-faking-permit-numbers-to-skirt-new-regulations-1.6335962\">nogle Airbnb-v\u00e6rter<\/a> bruger falske registreringsnumre. Det g\u00f8r det muligt for dem fortsat at drive deres virksomheder ulovligt og undg\u00e5 deres skatteforpligtelser. Det er dog relativt nemt at se, hvem der omg\u00e5r loven, da de bruger de samme numre.  <\/p>\n<p>Talsfolk for lokale myndigheder har antydet, at der kan komme flere indgreb.
