Skotlands hovedstad byder p\u00e5 betagende landskaber, dybe historiske r\u00f8dder og en enest\u00e5ende kulturscene. <\/p>\n<p>Edinburgh er en attraktiv investeringsmulighed for operat\u00f8rer af korttidsudlejning (STR). De skal blot sikre, at De f\u00f8lger de lokale love og opretholder rimelige standarder. Derfor dykker vi ned i byens STR-regler, herunder den nye licensordning og dens egnethedskriterier.  <\/p>\n<p><em>Ansvarsfraskrivelse: Vores guide er udelukkende til informationsform\u00e5l og udg\u00f8r ikke juridisk r\u00e5dgivning. For vejledning i konkrete sager bedes De kontakte en ejendomsadvokat.   <\/em><\/p>\n<h2>Hvad betragter Edinburgh som en korttidsudlejning?<\/h2>\n<p>Skotland definerer l\u00f8st en korttidsudlejning som en bolig, De udlejer til g\u00e6ster i midlertidige perioder. Det kan v\u00e6re en del af Deres hjem eller hele boligen. <\/p>\n<p>Loven angiver ikke, hvor l\u00e6nge g\u00e6ster kan blive ad gangen. I Storbritannien kan en v\u00e6rt acceptere bookinger fra \u00e9n enkelt nat til flere m\u00e5neder. De regnes dog automatisk som korttidsudlejning, hvis Deres bolig er tilg\u00e6ngelig til udlejning i 28 dage eller mere.  <\/p>\n<p>De regnes ikke som en STR i Edinburgh, hvis Deres g\u00e6ster er:<\/p>\n<ul>\n<li aria-level=\"1\">N\u00e6re familiemedlemmer<\/li>\n<li aria-level=\"1\">Deltagere i et uddannelsesprogram, De har arrangeret<\/li>\n<li aria-level=\"1\">Ejere eller medejere af boligen<\/li>\n<\/ul>\n<p>Definitionen omfatter heller ikke mange andre typer betalt overnatning, s\u00e5som hoteller, vandrehjem og studieboliger.<\/p>\n<h2>STR-kontrolomr\u00e5der i Edinburgh<\/h2>\n<p>Edinburgh Council har udpeget hele byen som et \u201cshort-term let control area\u201d. Det betyder, at De skal indhente byggetilladelse, f\u00f8r De kan udleje en sekund\u00e6r bolig til g\u00e6ster. Byen er en af kun to regioner i Skotland, der h\u00e5ndh\u00e6ver denne lov.  <\/p>\n<p>De kan tjekke <a href=\"https:\/\/www.edinburgh.gov.uk\/downloads\/file\/31823\/short-term-let-designation-map\">kommunekortet<\/a>, hvis De er i tvivl om, hvorvidt Deres bolig ligger inden for bygr\u00e6nsen. Bem\u00e6rk, at selv hvis De er uden for Edinburghs administrative omr\u00e5de, kan De stadig have brug for byggetilladelse. Det er altid bedst at dobbelttjekke med Deres lokale kommune.  <\/p>\n<p>Hvis De allerede har brugt en bolig til korttidsudlejning, kan De muligvis ans\u00f8ge om en undtagelse. Kommunen kalder dette en \u201ccertification of lawfulness\u201d. Egnethedskriterierne er dog meget begr\u00e6nsende \u2014 De skal kunne bevise, at korttidsudlejningen har v\u00e6ret i drift i over 10 \u00e5r uden afbrydelse.  <\/p>\n<h2>STR-licenser i Edinburgh<\/h2>\n<p>I oktober 2022 indf\u00f8rte den skotske regering en ny licensordning. Nu skal De ans\u00f8ge om den rette dokumentation, f\u00f8r De kan annoncere Deres STR eller tage imod g\u00e6ster. <\/p>\n<p>Ordningen g\u00e6lder for enhver form for korttidsindkvartering i Skotland. For at give Dem en id\u00e9 om omfanget er her de eksempler, regeringen n\u00e6vner: <\/p>\n<ul>\n<li aria-level=\"1\">Feriehytter<\/li>\n<li aria-level=\"1\">Bed &amp; Breakfasts<\/li>\n<li aria-level=\"1\">G\u00e6stehuse<\/li>\n<li aria-level=\"1\">Enkeltv\u00e6relser<\/li>\n<li aria-level=\"1\">Ukonventionel overnatning som f.eks. yurter<\/li>\n<\/ul>\n<h3>Betaling af STR-licensgebyrer<\/h3>\n<p>Licensgebyrerne i Edinburgh afh\u00e6nger af, om det er Deres prim\u00e6re eller sekund\u00e6re bolig.<\/p>\n<p>Hvis De udlejer eller deler Deres eget hjem, er det \u00e5rlige licensgebyr \u00a3120 pr. beboer. Det betyder, at hvis De kan tage op til fem g\u00e6ster, betaler De i alt \u00a3600. <\/p>\n<p>Licensgebyrerne er h\u00f8jere for dem, der bruger en sekund\u00e6r bolig. Det samlede bel\u00f8b afh\u00e6nger af det maksimale antal g\u00e6ster, De kan tage imod ad gangen. Hvis De blot \u00f8nsker at udleje Deres bolig i seks uger i sommerferien, kan dette v\u00e6re en bedre l\u00f8sning for Dem. <\/p>\n<h3>Ans\u00f8gning om en STR-licens i Edinburgh<\/h3>\n<p>Det er bedst at ans\u00f8ge om en STR-licens i god tid. Kommunen kan bruge op til ni m\u00e5neder p\u00e5 at behandle ans\u00f8gninger og tr\u00e6ffe afg\u00f8relse. <\/p>\n<p>De kan downloade <a href=\"https:\/\/www.edinburgh.gov.uk\/downloads\/file\/33304\/short-term-let-application-form.pdf\">ans\u00f8gningsskemaet til korttidsudlejning<\/a> fra Edinburgh Councils hjemmeside. Bem\u00e6rk, at det ikke er digitalt, s\u00e5 De skal udskrive skemaet, udfylde det i h\u00e5nden og scanne det bagefter. De b\u00f8r sende skemaet tilbage til kommunen sammen med f\u00f8lgende dokumenter:  <\/p>\n<ul>\n<li aria-level=\"1\">En plantegning<\/li>\n<li aria-level=\"1\">En rapport om elinstallation<\/li>\n<li aria-level=\"1\">Et \u00e5rligt certifikat for test af b\u00e6rbare elektriske apparater<\/li>\n<li aria-level=\"1\">Et gascertifikat (hvis relevant)<\/li>\n<li aria-level=\"1\">Byggetilladelse (hvis relevant)<\/li>\n<\/ul>\n<p>Som en del af ans\u00f8gningen skal De underskrive en erkl\u00e6ring, der bekr\u00e6fter, at De p\u00e5 anmodning kan fremvise dokumentation for forsikring og et energim\u00e6rke.<\/p>\n<p>Mens De venter p\u00e5 kommunens svar, skal De opsl\u00e5 en meddelelse p\u00e5 Deres ejendom i mindst 21 dage. Den kan De downloade fra kommunens hjemmeside. De skal placere meddelelsen et sted, hvor forbipasserende let kan l\u00e6se den, f.eks. i et vindue i stueplan eller p\u00e5 et hegn.  <\/p>\n<h3>Overholdelse af Edinburghs STR-regler<\/h3>\n<p>STR-operat\u00f8rer skal f\u00f8lge visse regler og opfylde fastsatte standarder, ellers kan Edinburgh City Council inddrage deres licens. Her er en oversigt over de vigtigste: <\/p>\n<ul>\n<li aria-level=\"1\">De m\u00e5 ikke overskride den bel\u00e6gningsgr\u00e6nse, der er angivet p\u00e5 Deres licens.<\/li>\n<li aria-level=\"1\">Boliger b\u00f8r fremvise en kopi af licensen, el- og gascertifikaterne samt kontaktoplysninger til alarmtjenesterne.<\/li>\n<li aria-level=\"1\">Alle annoncer skal indeholde boligens licensnummer og energim\u00e6rkning. De faciliteter og ydelser, De annoncerer, skal stemme overens med det, der faktisk er tilg\u00e6ngeligt p\u00e5 overnatningsstedet. <\/li>\n<li aria-level=\"1\">De skal sikre, at De har l\u00f8bende bygnings- og ansvarsforsikring i hele licensperioden.<\/li>\n<\/ul>\n<p>Som ejer eller administrator er De ogs\u00e5 ansvarlig for Deres g\u00e6sters adf\u00e6rd. Kommunen kan give Dem en b\u00f8de, hvis de forstyrrer naboerne eller for\u00e5rsager skade p\u00e5 n\u00e6romr\u00e5det. De vil dog f\u00f8rst fors\u00f8ge at l\u00f8se situationen sammen med Dem.  <\/p>\n<h2>Skattekrav for STR\u2019er i Edinburgh<\/h2>\n<p>Edinburgh anvender ingen s\u00e6rlige satser for STR-operat\u00f8rer. De skal blot betale almindelig indkomstskat, kapitalgevinstskat og moms ligesom i resten af Storbritannien. <\/p>\n<p>De skal betale kommuneskat, hvis Deres bolig enten er:<\/p>\n<ul>\n<li aria-level=\"1\">Tilg\u00e6ngelig til udlejning i under 140 dage om \u00e5ret<\/li>\n<li aria-level=\"1\">Udlejet i mindre end 70 dage om \u00e5ret<\/li>\n<\/ul>\n<p>Det g\u00e6lder uanset, om De har en licens eller betaler kommuneskat et andet sted. De er kun undtaget, hvis De f\u00e5r langtidslejere. <\/p>\n<p>Alle andre skal betale business rates (ogs\u00e5 kaldet non-domestic rates). Hvis De administrerer ejendomme p\u00e5 tv\u00e6rs af Storbritannien, skal De v\u00e6re opm\u00e6rksom p\u00e5, at systemet til beregning af bel\u00f8bene er forskelligt i Skotland og England. <\/p>\n<p>Er De i tvivl om, hvorvidt De skal betale kommuneskat eller business rates? De kan kontakte en assessor for at v\u00e6re sikker. <\/p>\n<h2>Kommende \u00e6ndringer af STR-lovgivningen i Storbritannien<\/h2>\n<p>Den britiske regering lancerer en landsd\u00e6kkende STR-licensordning i 2024. Ans\u00f8gere vil ogs\u00e5 blive p\u00e5lagt at indhente byggetilladelse, hvis de ikke allerede har gjort det. <\/p>\n<p>Da regeringen stadig er i gang med at udforme lovgivningen, er nogle detaljer stadig uklare. For eksempel kan boligejere muligvis stadig udleje deres boliger i op til 90 dage om \u00e5ret. Regeringen har ogs\u00e5 indikeret, at eksisterende STR\u2019er automatisk vil f\u00e5 byggetilladelse.  <\/p>\n<p>Edinburgh har allerede implementeret lignende regler, s\u00e5 der er muligvis ikke stor p\u00e5virkning af STR\u2019er, der drives i byen. Den skotske regering kan dog tilpasse nogle af sine politikker, s\u00e5 de passer til den britiske lovgivning.
