Hosts in San Diego must apply for a Transient Occupancy Registration Certificate and pay the Transient Occupancy Tax (TOT) and the Tourism Marketing District (TMD). San Diego has several ordinances that affect short-term rentals which are:
- Article 141.0603: regulations affecting bed and breakfasts. The ordinance is straightforward to interpret and limits where food can be prepared, off-street parking and how the structure can be setup.
- Article 141.0301: regulations for boarder and lodger rooms. Under this ordinance, no more than two boarders or lodgers are permitted per primary dwelling. There are also limitations on-street parking for boarders or lodgers.
- Article 52.91: the posting of rates, rules and regulations, and registration of guests.
